Description

In the Framework Agreement on First Nation Land Management, enacted by the Framework Agreement on First Nation Land Management Act, the federal government established a system for the registration of interests in First Nation lands. The First Nations Land Registry maintains abstracts for each reserve and every individual parcel of reserve land for each First Nation that is subject to the act.

Previous provisions of the act required Canada to administer and maintain the First Nations Land Registry in the same manner as the Reserve Land Register established under the Indian Act. An amendment to the act has enabled the Governor in Council to create regulations relating to the transfer of the administration of the First Nations Land Registry to any person or body and the disclosure of personal information for that purpose.

Regulatory cooperation efforts (domestic and international)

The department will work with the Lands Advisory Board and the First Nations Land Management Resource Centre. This initiative is not under a specific formal regulatory cooperation work plan.

Potential impacts on Canadians, including businesses

The regulatory changes affect First Nations already participating in First Nations Land Management and future entrants, as well as a small segment of the general public and businesses who have engaged in, or will be engaging in, land transactions on First Nation lands.

These changes are expected to support First Nations that are operational under the Framework Agreement on First Nation Land Management to take on further control in land management and provide access to modern technology, which will support increased access to land-based economic opportunities.

Consultations

No consultation is required beyond that which may have been and continues to be conducted by First Nations' leadership with their community members and by Crown-Indigenous Relations and Northern Affairs Canada with the Lands Advisory Board and the First Nations Land Management Resource Centre.
